Sun Legal Update: Thailand Bar Opening Hours Survey Underway

The Ministry of Tourism and Sports is conducting surveys of key night spots in Thailand to determine the viability of extending bar and nightclub opening hours to 4 a.m.

The survey results will reviewed before a discussion on proposed ministerial regulations that would be issued by the Public Health and interior ministries with a plan to create curfew-free zones in Phuket, Pattaya, Samui and Khao San Road in Bangkok.

It is predicted that the extended hours could increase turnover by 23-24%.

Thailand’s meetings, incentives, conference and exhibition sector continues to grow with more than 100,000 events expected this year.

Bangkok, Phuket and Pattaya were named as the top places for business meetings, with Hua Hin, Krabi and Khao Lak also ranking highly. Last month, Thailand was named the best destination in Asia by MICE professionals for the second consecutive year at M&C Asia Stella Awards.

Board of Investment Firms Can Own Land

The Board of Investment issued new regulations allowing for BoI-promoted and foreign-owned companies to own land for certain purposes:

  • The company must have more than 50 million baht in capitalization.
  • The land area for the office location must not exceed five rai.
  • The land area for residential buildings for executives or experts must not exceed 10 rai.
  • The land area for residential buildings for employees must not exceed 20 rai.
  • The land for the office and the residential buildings may be in or outside the land area in which the business operation building of the BoI-promoted foreign juristic person is located.
  • The land ownership must be disposed of within one year after that person’s status expires or is withdrawn.

The BoI may issue additional terms and conditions as appropriate, including the types of eligible businesses, the distance between the business location, and the land to be owned under this announcement if they are not located in the same location.

Starting a BoI-promoted business requires that the business be incorporated in Thailand first before applying for promotion. Promotion is also limited to certain types of businesses in key industries.
